These Terms of Service ("Terms") govern your access to and use of the SupaChef mobile application (the "App," "Service," or "SupaChef") provided by Flexstack Platforms ("we," "us," or "our"). By accessing, downloading, or using SupaChef, you agree to be bound by these Terms, our [Privacy Policy](https://www.supachef.app/privacy), and our [Community Guidelines](https://www.supachef.app/community), which are incorporated by reference. If you do not agree to these Terms, you must not access or use our Service. We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email at least 30 days before they take effect. Your continued use of SupaChef after changes become effective constitutes your acceptance of the revised Terms. ## Eligibility and Account Requirements ### Age Requirements * You must be at least 13 years old to use SupaChef * If you are between 13 and 18 years old, you may only use SupaChef with the permission and supervision of your parent or legal guardian * Your parent or legal guardian must review and agree to these Terms on your behalf ### Geographic Restrictions * SupaChef is currently available only to residents of Canada * You represent that you are located in Canada when using our Service ### Account Creation When you create a SupaChef account, you must: * Provide accurate, current, and complete information * Maintain and promptly update your account information * Keep your login credentials secure and confidential * Not share your account with others * Immediately notify us of any unauthorized use of your account You are responsible for all activities that occur under your account, whether or not you authorized such activities. ## Description of Service SupaChef is a cooking-focused mobile application that provides: **Recipe Search and Discovery** * Search for recipes using our search functionality * Browse public recipes with images, videos, descriptions, and author information * View recipe recommendations based on your interests and activity **Private Recipe Management** * Create, store, and manage your private recipes * Upload images and videos for your recipes * Add detailed descriptions, ingredients lists, and cooking instructions * Delete your recipes at any time (deletion is permanent and cannot be undone) **Interactive Cooking Tutorials** * Participate in drag-and-drop, game-based cooking experiences * Learn cooking techniques through interactive tutorials * Track your progress and performance in cooking games **Account Management** * Create and manage your user account * Log in and log out of the Service * Control your privacy settings and data preferences * Delete your account and associated data ## User Content and Recipes ### Your Recipe Content When you create and upload recipes, images, videos, or other content to SupaChef ("User Content"), you retain ownership of your content. However, by uploading User Content to our Service, you grant us certain rights as described below. ### License to Use Your Content By providing User Content through SupaChef, you grant us a non-exclusive, royalty-free, worldwide license to: * Store and display your private recipes for your personal use * Process your content to provide our Service features * Make technical copies necessary for backup and service operation * Use anonymized, aggregated data derived from your content to improve our Service This license continues until you delete your content or terminate your account. ### Content Standards All User Content must: * Be your original creation or content you have the right to use * Not infringe on any third party's intellectual property rights * Not contain harmful, offensive, or illegal material * Comply with all applicable laws and regulations * Not contain spam, malware, or other malicious content * Follow our [Community Guidelines](https://www.supachef.app/community), which provide detailed standards for acceptable content and behavior on SupaChef ### Content Removal We reserve the right to remove or restrict access to any User Content that: * Violates these Terms, our [Community Guidelines](https://www.supachef.app/community), or our policies * Infringes on third party rights * Is reported by other users as inappropriate * We believe poses a risk to our Service or users ## Prohibited Uses You agree not to use SupaChef to engage in activities that violate these Terms or our [Community Guidelines](https://www.supachef.app/community), including: **Illegal or Harmful Activities** * Violate any applicable laws, regulations, or third party rights * Engage in fraudulent, deceptive, or misleading activities * Upload or distribute malicious software, viruses, or harmful code * Attempt to gain unauthorized access to our systems or other users' accounts **Service Abuse** * Use automated tools, bots, or scripts to access our Service * Attempt to reverse engineer, decompile, or disassemble our App * Interfere with or disrupt our Service or servers * Circumvent any security measures or access controls **Content Violations** * Upload content that infringes on copyrights, trademarks, or other intellectual property * Post offensive, threatening, harassing, or discriminatory content * Share false, misleading, or inaccurate recipe information * Impersonate others or misrepresent your identity **Commercial Misuse** * Use SupaChef for unauthorized commercial purposes * Sell, rent, or transfer your account to others * Extract or harvest data from our Service for commercial use ## Intellectual Property Rights ### SupaChef's Intellectual Property SupaChef and all related technology, software, features, and content (excluding User Content) are owned by Flexstack Platforms and protected by copyright, trademark, and other intellectual property laws. You may not: * Copy, modify, or create derivative works of our App or Service * Use our trademarks, logos, or branding without permission * Remove or alter any copyright or proprietary notices ### Respect for Others' Rights We respect intellectual property rights and expect our users to do the same. If you believe content on SupaChef infringes your rights, please contact us at [legal@supachef.app](mailto:legal@supachef.app) with details of the alleged infringement. ## Privacy and Data Protection Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our [Privacy Policy](https://www.supachef.app/privacy), which is incorporated into these Terms by reference. Key privacy points: * We collect only the information necessary to provide our Service * You have control over whether your usage data is linked to your account * We use strong security measures to protect your information * We do not sell or rent your personal information to third parties Please review our [Privacy Policy](https://www.supachef.app/privacy) for complete details about our data practices. ## Service Availability and Modifications ### Service Availability As a new application with limited staff, we reserve the right to: * Modify, suspend, or discontinue SupaChef or any features at any time * Shut down backend services if necessary to protect user security and privacy * Implement maintenance periods that may temporarily limit access We will make reasonable efforts to notify users of significant service changes, but we cannot guarantee advance notice in all circumstances. ### Data Preservation While we will make best efforts to preserve your data during service modifications: * We cannot guarantee data retention during security incidents or service shutdowns * User privacy and security take priority over data convenience * We recommend regularly backing up important recipe content ### Service Improvements We may update SupaChef to: * Fix bugs and improve performance * Add new features and functionality * Enhance security and privacy protections * Comply with legal requirements ## Disclaimers and Warranties ### Service Provided "As Is" SupaChef is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including: * Warranties of merchantability or fitness for a particular purpose * Warranties that the Service will be uninterrupted, secure, or error-free * Warranties regarding the accuracy or reliability of content ### Recipe Content Disclaimer * We do not verify the accuracy, safety, or quality of user-generated recipes * You use recipe information at your own risk * We are not responsible for any adverse effects from following recipes on our platform * Always use your judgment and consider food allergies and dietary restrictions ### No Professional Advice SupaChef is for entertainment and educational purposes only. We do not provide professional cooking, nutritional, or dietary advice. ## Limitation of Liability To the maximum extent permitted by law: ### Limited Liability Our total liability to you for any claims arising from or related to SupaChef will not exceed CAD \$100 or the amount you paid us in the 12 months preceding the claim, whichever is greater. ### Excluded Damages We will not be liable for: * Indirect, incidental, special, consequential, or punitive damages * Loss of profits, data, use, goodwill, or other intangible losses * Damages resulting from your use of or inability to use our Service * Damages caused by third party content or actions * Damages from unauthorized access to your account or data ### Exceptions These limitations do not apply to: * Damages caused by our gross negligence or willful misconduct * Liability that cannot be excluded under applicable law * Our obligations under consumer protection laws ## Indemnification You agree to indemnify, defend, and hold harmless Flexstack Platforms, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: * Your use of SupaChef in violation of these Terms * Your User Content or any claims that it infringes third party rights * Your violation of any applicable laws or third party rights * Any false or misleading information you provide to us ## Dispute Resolution ### Informal Resolution Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute with us informally by contacting [legal@supachef.app](mailto:legal@supachef.app). We will work in good faith to resolve disputes within 90 days of receiving notice. ### Arbitration If informal resolution is unsuccessful, any dispute arising from or relating to these Terms or SupaChef will be resolved through binding arbitration in British Columbia, Canada, rather than in court. **Arbitration Process:** 1. **First Choice:** Vancouver International Arbitration Centre 2. **Second Choice:** Alternative Dispute Resolution Institute of BC (if both parties agree or there is demonstrable reason) 3. **Final Choice:** Canadian Arbitration Association (if both parties agree or there is demonstrable reason) **Arbitration Rules:** * Arbitration will be conducted under the rules of the chosen arbitration organization * The arbitrator's decision will be final and binding * Each party will bear their own costs unless the arbitrator decides otherwise * Arbitration will be conducted in English ### Class Action Waiver You agree that any arbitration or legal proceeding will be conducted only on an individual basis and not as part of a class, collective, or representative action. ## Termination ### Termination by You You may terminate your account at any time by: * Using the account deletion feature in the App * Contacting us at [support@supachef.app](mailto:support@supachef.app) * Following the account closure process we provide ### Termination by Us We may suspend or terminate your account if: * You violate these Terms, our [Community Guidelines](https://www.supachef.app/community), or our policies * You engage in fraudulent or harmful activities * We are required to do so by law * We discontinue the Service ### Effects of Termination Upon termination: * Your access to SupaChef will be immediately revoked * We may delete your account and User Content * You remain liable for any obligations incurred before termination * Sections of these Terms that should survive termination will continue to apply ## General Provisions ### Governing Law These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any legal action not subject to arbitration must be brought in the courts of British Columbia. ### Entire Agreement These Terms, together with our [Privacy Policy](https://www.supachef.app/privacy) and [Community Guidelines](https://www.supachef.app/community), constitute the entire agreement between you and us regarding SupaChef and supersede any prior agreements. ### Severability If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. ### No Waiver Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. ### Assignment You may not assign or transfer these Terms or your account without our written consent.
